The European Ombudsman has found the Irish authorities have not breached European law in refusing to allow a Ballinasloe man home because he's using cannabis for medicinal purposes.

34 year old Noel McCullagh lives in Amsterdam and is being treated for multiple sclerosis.

Each time Noel McCullagh has sought permission from the Irish authorities to return home to visit Ballinasloe, he has been told he would be arrested on arrival for possession of cannabis.

In his judgement published today, European Ombudsman P Nikiforos Diamandouros said he was deeply touched by Mr McCullagh's case but found no breach of European law in the matter.
