A motorist was successful this week in having a conviction for driving while under the influence of cocaine quashed on appeal at Galway Circuit Criminal Court.22 year old Mark Barry, formerly of 25 Tudor Vale, Oranmore, and who now lives at 249 Ros Caoin, Roscam, was sentenced to five months in prison and was disqualified from driving for four years at Galway District Court on May 14 last.He had denied a charge of driving while under the influence of an intoxicant to such an extent as not to have proper control of his car at Tudor Vale, Oranmore, on April 24 last year.Conal McCarthy, BL, said there was undue delay between the time the first Garda test results came back in early May with a nil alcohol reading, and the time the second results regarding the drugs analysis were sent to him in early September.Judge Raymond Groarke agreed with the barrister that there had been undue delay in test results coming back from the Medical Bureau and he allowed the appeal.
