Gardai have yet to use a "discretionary" power which would enable them to remove the Occupy Galway camp in the city.

It follows a formal request by Galway City Council last week to have the protestors moved on.

Following legal advice, city officials asked Gardai to invoke their powers under the Criminal Justice Public Order Act 1994.

Garda Superintendent Marie Skehill says the demonstrators are not committing an offence and that there are no reports of disturbances from the public.

However Superintendent Marie Skehill says that power is "discretionary".
